(June 2024) HUD Updated Gift Fund Guidelines: Increasing Flexibility on FHA Loans

As of June 2024, the Department of Housing and Urban Development (HUD) has introduced significant updates to make homeownership more affordable and accessible for FHA loan borrowers. One of the most notable changes is the increased flexibility surrounding gift funds, which are monetary gifts from friends or family that can be used for a Down Payment and other homebuying expenses. Here’s what first-time home buyers need to know about these exciting updates.

What Are Gift Funds?

Gift funds are financial gifts that borrowers receive from family members, friends, or other eligible sources to help cover costs associated with buying a home, such as the Down Payment. Previously, the FHA had strict documentation requirements for these gifts, making it challenging for some borrowers to use them.

Key Updates to Gift Fund Guidelines (as of June 2024)

  1. Simplified Documentation:
    • More Options for Proving Gift Donations: The FHA has simplified the process for verifying gift funds, allowing for a variety of documentation methods. This change makes it easier for borrowers to prove that they have received financial support from loved ones.
  2. Increased Flexibility:
    • Easier to Get Financial Support: Borrowers now have more flexibility in receiving and documenting gift funds, making it easier to get the financial help they need to buy a home.

Details of the New Verification Process

Under the updated guidelines, borrowers can now verify gift funds without requiring the donor’s bank statement. Instead, any of the following can be used:

  • Copy of the Donor’s Canceled Check: Along with evidence of deposit into the Borrower’s account.
  • Copy of the Donor’s Withdrawal Receipt: Plus proof of deposit to the Borrower’s account.
  • Evidence of Electronic Transfer: From the donor’s account to the Borrower’s account.

These options provide greater flexibility and reduce the documentation burden on both donors and borrowers, streamlining the homebuying process.

Who Can Give Gift Funds?

Eligible sources for gift funds under the updated FHA guidelines include:

  • Family Members: Parents, siblings, children, and other close relatives.
  • Borrower’s Employer or Labor Union: Financial support from your workplace.
  • Close Friends: Must have a clearly defined and documented interest in the Borrower.
  • Charitable Organizations: Non-profits that provide homebuying assistance.
  • Government Agencies: Agencies that offer Down Payment assistance (DPA).

How These Changes Benefit First-Time Home Buyers

These updates from HUD are designed to make the path to homeownership smoother and more accessible. By simplifying the documentation process and broadening the options for receiving gift funds, more borrowers can secure the financial support they need. This is especially beneficial for first-time home buyers who might rely on family and friends to help with the costs of purchasing a home.
